TERMS & CONDITIONS
Please Read the following terms carefully. By registering for this auction, you acknowledge that you have read and understood all terms and conditions.

REAL ESTATE: Lots 1, 15, 20, 23R, 24R, 26, 29, 30, 37, 40, 42, 66, 72R, 73R, 109-110 in Stonebridge on Douglas Lake, Dandridge TN shall be offered at public auction.

BIDDING PROCEDURES: Open and verbal. Announcements made on the day of the auction will take precedence over all printed material or oral statements made. (1) Method, order of sale, and bidding increments shall be at the sole discretion of the auctioneer. (2) The auctioneer reserves the right to delete or add additional properties at their discretion. (3) The auctioneer has the authority, at his sole and absolute discretion, to deviate from, change, alter, or modify the bidding procedures and conduct of the auction at any time including after commencement of the auction.

BIDDING: All bidding is open to the public. As used in these conditions of sale the term “the final bid” means the highest bid acknowledged by the auctioneer, and the term “purchase price” means the sum of the final bid and the buyer’s premium. The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to reject any bid. In the event of any dispute between bidders, the auctioneer may determine the successful bidder or re-offer and resell the property in dispute. Should there be any dispute after the sale; record of final sale shall be conclusive.

AS IS/ WHERE IS: All properties are selling “As-Is, where is” with all faults. It is the buyer’s responsibility to conduct any and all inspections and perform all acts of due diligence deemed necessary before bidding. Placing a bid will be considered as acceptance of the property in it’s as-is condition.

ONLINE BIDDER VERIFICATION: For verification purposes, a credit card is required to register. Upon registering, an authorization of $1,000.00 will be required. Hurst Real Estate & Auction reserves the right to reject or accept bidder registrations at its sole discretion.

AGENCY DISCLOSURE: Hurst Real Estate & Auction is acting as agent for the seller and at no time is Hurst Real Estate & Auction responsible for, acting on behalf of, or acting as agent for the buyer.

BUYERS PREMIUM: A 10% Buyer’s Premium will be added to the bid price for each property to determine the final contract price. For example, if you bid $100,000, 10% ($10,000) will be added, resulting in a total contract price of $110,000

LIVE BIDDER TERMS: 10% deposit of Total Purchase Price with signed contract today, balance due at closing in 30 days or less. A 10% buyer’s premium will be added to your bid for the final purchase price.

ONLINE BIDDER TERMS: Successful online bidders will electronically sign contract day of sale. 10% depost of Total Purchase Price shall be paid the following business day by wire transfer, balance due at closing in 30 days or less. A 10% buyer’s premium will be added to your bid for the final purchase price.

FINANCING: Sale of the property is not contingent upon the buyer obtaining financing.

UTILITIES: Utility water is available thru Dandridge Utility. Power is available thru Appalachian Electric. Sewer is maintained by the community sewer system

HOA: Stonebridge on Douglas Lake HOA fees are $600.00 per year per lot. HOA fees shall be prorated between buyer and seller at closing

HOA ASSESSMENTS: Stonebridge on Douglas Lake HOA has issued a $2,500.00 road improvement assessment for each lot. Some lots are current with their assessments some lots are not, we will announce the status of each lot as we come to it in the auction

TAXES: Taxes shall be prorated between buyer and seller at closing.

CLOSING: Buyer will pay all recording fees and any loan expenses. A local title company will close the sale. There will be a small closing fee charged to both the buyer and the seller by the title company.

INSPECTION: All property is sold “As Is, With All Faults.” Descriptions are provided as a service to customers only and do not constitute a warranty, either expressed or implied. Hurst Real Estate & Auction disclaims all responsibility for physical condition. All buyers are responsible for prior inspection of properties on which they bid, and by bidding are deemed to have so inspected the property. Placing a bid on the offered property, whether in person, or by agent, by written bid, telephone bid or other means, constitutes an agreement by bidder to these conditions of sale. For residences built prior to 1978, buyer waives the right to a 10 calendar-day opportunity to conduct a risk assessment or inspection for the presence of Lead-Based Paint and/or Lead-Based Paint Hazards.
